Announcement No.97, 2006 of Ministry of Commerce, Deciding to Carry out Mid-term Review of Dumping and Dumping Margin on Imported Styrene-butadiene Rubber (SBR) Originated from Korea Jinhu Petrochemical Co.,Ltd.
Ministry of Commerce released Announcement No.49, 2003 on Sep 9, 2003, deciding to impose anti-dumping duties on Styrene-butadiene rubber (SBR, hereinafter referred to as “investigated commodity”) originated from Russia, the Republic of Korea and Japan. The anti-dumping duty rate applicable to Jin hu Petrochemical Co.,Ltd. is 7 percent.
In accordance with regulations of Article 49 of Anti-dumping Regulations of the People’s Republic of China and Provisional Regulations on Mid-term Review of Dumping and Dumping Margin, Ministry of Commerce may decides to carry out review on anti-dumping duties with warrants or undertake review in r esponse to application of parties of interests after a reasonable period.
On Sep 28, 2006, Korea Jinhu Petrochemical Co.,Ltd applied for mid-term review on dumping and dumping margin to Ministry of Commerce, claiming that since the implementation of anti-dumping measures, the dumping margin of the investigated commodities is reduced.
In accordance with Provisional Regulations on Mid-term Review of Dumping and Dumping Margin, Ministry of Commerce informed the original applicants in 7 working days, who didn’t make comment on whether to put the case on record or not.
With examination on application letter, Ministry of Commerce believes the application letter put forward by Korea Jinhu Petrochemical Co.,Ltd includes fundamental evidence and conforms to Article 49 of Anti-dumping Regulations of the People’s Republic of China and Article 6 and 10 of Provisional Re gulations on Mid-term Review of Dumping and Dumping Margin. Therefore, Ministry of Commerce decides to carry out mid-term review of dumping and dumping Margin on imported SBR originated from Korea Jinhu Petrochemical Co.,Ltd.
The investigation period is from Jul 1, 2005 to Jun 30, 2006. The scope of the commodities of review is same to that of the anti-dumping measures, which is under items 40021911, 40021912 and 40021919 in PRC Customs Import Tariff Code.
