Ministry of Commerce released announcement No.61, 2003 on Nov 22, 2003, deciding to carry out anti-dumping investigation on TDI (type of TDI80/20, hereinafter referred to as “investigated commodity”) originating from Japan, the Republic of Korea and the United States. The rate of anti-dumping duti es on MITSUI TAKEDA CHEMICALS, INC. was 4 percent.
In response to applying of domestic industry, Ministry of Commerce released Announcement No.5, 2005 on Feb 3, 2005, deciding to carry out midterm interview on dumping and dumping profit margin of investigated commodities originating from Japan and the Republic of Korea. In accordance with result of the investigation, Ministry of Commerce released Announcement No.115, 2005 on Jan 10, 2006,deciding to adjust the rate of anti-dumping duties on imported investigated commodities originating from Japan and the Republic of Korea. The anti-dumping duties rate on MITSUI TAKEDA CHEMICALS, INC. was adjus ted to 12.45 percent while the rate of other companies of Japan was adjusted to 60.02 percent.
On Mar 9, 2006, MITSUI TAKEDA CHEMICALS, INC. put forward application to Ministry of Commerce, saying the name of the said company would be changed into MITSUI CHEMICALS POLYURETHANES, INC. as from Apr 1, 2006, and applying to let MITSUI CHEMICALS POLYURETHANES, INC. to succeed the anti-dumping duti es rate of MITSUI TAKEDA CHEMICALS, INC.. In accordance with requirements of investigating organs, the said companies submitted supplementary materials of application.
The investigating organs informed the original applicant of the name alteration of the company. As original applicant, domestic industry submitted related comments and opinions and MITSUI CHEMICALS POLYURETHANES, INC. provided answers to the comments and opinions.
In line with investigating result, Ministry of Commerce confirms that the current evidences indicate that the stock equity of MITSUI TAKEDA CHEMICALS, INC. has been transferred through merger and acquisition; name of the company has been altered; and the material supply, manufacturing equipments, sa les clients and operation management stay unchanged after the name alteration. Therefore, Ministry of Commerce decides that MITSUI TAKEDA CHEMICALS, INC. shall succeed anti-dumping duties rate applicable for MITSUI TAKEDA CHEMICALS, INC., that is 12.45 percent as from the day; company exporting in n ame of MITSUI TAKEDA CHEMICALS, INC. will be imposed a anti-dumping duty of 60.02 percent as from the day, which is applicable for “all other Japanese companies “.
