Regulations on Customs Statistics

Article 1 These Regulations are formulated in accordance with the Customs Law of the People’s Republic of China and Statistics Law of the People’s Republic of China for the purposes of carrying out customs statistics scientifically and effectively, assuring the accuracy, timeliness and completenes
s of customs statistics.
  Article 2 Customs statistics is the statistics of the customs for trade on import and export commodities according to law, is an integrant of the statistics of national economy.
  The task of customs statistics is to conduct statistics investigation, statistics analysis and statistics investigation on the trade of import and export goods, give early warning for export survey, draw up, manage and publish customs statistical materials, and provide statistics service.
  Article 3 The General Administration of the Customs (GAC) is responsible for organizing and administering customs statistics.
  The organs and staffs for customs statistics shall perform their duties according to Statistics Law of the People’s Republic of China and Detailed Rules for Implementation of Statistics Law of the People’s Republic of China .
  Article 4 The commodities that are really imported and exported and caused increase or decrease of domestic substance stocks are listed into customs statistics.
  The import and export articles that exceeds the range of self-use and reasonable quantity are listed into customs statistics.
  Article 5 Following commodities are not listed into customs statistics.
  1. Floating, transit and through commodities;
  2. Temporary import and export commodities;
  3. Currency and monetary commodities;
  4. Leased import and export commodities that the leased period of them is less than one year;
  5. The import and export commodities compensated or changed freely due to damage, shortage, poor quality or not up to standard;
  6. Other commodities which are not listed into customs statistics stipulated by the GAC.
  Statistical items of import and export commodities include:
  1. Name and code of commodity;
  2. Quantity and price;
  3. Business unit;
  4. Terms of trade;
  5. Way of transportation;
  6. Country (region) of origin, country (region) of shipment, and final destination of import goods ;
  7. Country (region) of final destination, country (region) of destination and place of origin of export goods;
  8. Date of import and export;
  9. Customs;
  10. Other statistical items stipulated by the GAC.
  The GAC may adjust the statistical items in light of the development of national economy and the needs of customs supervision and administration.
  Article 7 The names and codes of import and export commodities shall be sorted out according to Commodity Catalogue of Customs Statistics of the People's Republic of China .
  The quantity of import and export commodities shall be counted up according to the measuring unit stipulated by Commodity Catalogue of Customs Statistics of the People's Republic of China .
  Commodity Catalogue of Customs Statistics of the People's Republic of China shall be promulgated by the GAC.
  Article 8 The price of import commodities shall be counted up according to the sum of the price of commodities, the transportation before the commodities are loaded and unloaded when they arrive in the place of importation within the territory of the People's Republic of China and corresponding cost
and insurance.
  The price for export commodities shall be counted up according to the sum of the price of commodities, the transportation before the commodities arrive in the place of exportation and loaded and unloaded within the territory of the People’s Republic of China and corresponding cost and insurance. In
which the sum of export tariff shall be cut off.
  Article 9 As for import commodities, the country (region) of origin, country (region) of shipment and the final destination shall be counted separately.
  As for export commodities, the country (region) of final destination, country (region) of destination and place of origin within the boundaries.
  Article 10 The business units for import and export commodities shall be counted up according to the legal persons, other organizations or individuals engaged in import and export business registered in the customs.
  Article 11 The terms of trade for import and export commodities shall be sorted out according to the requirements of the customs supervision and administration.
  Article 12 The way of transportation for import and export commodities shall be counted up according to the way of transportation when the commodity entry or exit of the country, including water transportation, railway transportation, road transportation, air transportation and other ways of transpo
rtation.
  Article 13 The date of import commodities shall be counted up according to the date of customs clearance. The date of export commodities shall be counted up according to the date of handling and winding up the customs formalities.
  Article 14 The statistics of import and export commodities shall be conducted by the customs responsible for accepting the declaration.
  Article 15 Customs statistical materials include original statistical materials of the customs and corresponding statistical information collected and sorted out on the basis of original materials.
  The original customs statistical materials in terms of above paragraph mean bill of entry and other corresponding bills and certificates for the import and export commodities confirmed by the customs.
  Article 16 The GAC shall provide corresponding comprehensive statistical materials to relative departments of the State Council periodically without compensation.
  The customs directly under the GAC shall provide corresponding comprehensive statistical materials periodically without compensation to relative departments of the People’s government of the province, autonomous region, municipality directly under the Central government where it is located.
  Article 17 The customs shall establish rules on period publication of statistical materials, publishing the statistical information of the customs to the society.
  The customs may provide statistical service in light of the needs of the social public.
  Article 18 The statisticians of the customs shall be obliged to keep national secret and commercial secret known during the statistics in secrecy.
  Article 19 A litigant has the right to inquire about the original statistical materials of the customs and corresponding information declared by himself within the length for preservation and may apply to the customs for confirmation for any doubt about the inquiry. The customs shall confirm it and
answer corresponding questions.
  Article 20 If the customs has any doubt about the items that the litigant shall declare according to law, it may inquire the litigant into it and the litigant shall reply in time.
  Article 21 Whoever does not declare the item that shall be declared according to law or whose declaration is not true and influence the result of customs statistics, the customs shall order the person concerned to make correction and give punishment to the one who should be given the administrative
sanction in accordance with Regulations for Implementation of Administrative Sanctions of the Customs of the People’s Republic of China.
  Article 22 These regulations shall come into effect as of March 1, 2006.
